The information and guidance provided by Revenue Cycle Inc. is subject to the following terms and limitations and by using this information or guidance you agree to such terms and limitations.

  • I. Analysis of federal / state regulations and health plan billing or payment policies
    • A. The opinions expressed by RCI regarding the applicability, interpretation or impact of any federal or state law or regulation or health plan billing, coding or payment policy are only the opinions of RCI. Such opinions are not intended to address specific facts and circumstances. RCI summaries of federal or state laws or regulations or health plan billing, coding or payment policies may omit information that is applicable to you. You should not rely on the opinions of RCI without consulting with a qualified attorney as to the applicability, interpretation or impact of any federal or state law or regulation or health plan billing, coding or payment policy relative to your specific facts and circumstances. RCI is not legal counsel, is not a substitute for legal counsel, and does not purport to provide legal advice.
    • B. Federal and state laws and regulations and health plan billing, coding or payment policies, and the interpretations thereof, are subject to change; unless specifically undertaken in writing by RCI, RCI has no obligation to update or revise any opinions or information regarding any federal or state law or regulation or health plan billing, coding or payment policy and it is your sole responsibility to verify that any such opinion or information is valid at the time you view, access, use or rely on such opinion or information.
  • II. Analysis of client information
    • A. RCI relies on the accuracy of information provided by you to assess your business operations, practices or data; to the extent you provide information that is inaccurate or incomplete, RCI is not responsible for errors in RCI’s assessment related to such inaccuracy or incompleteness. RCI has no obligation to verify the accuracy or completeness of information you provide to RCI. RCI has no obligation to identify, investigate or otherwise address any issue outside of RCI’s scope of engagement. Unless specifically undertaken by RCI, RCI does not represent or warrant that its analyses are statistically-valid under any standard; RCI assumes that all sample data you provide is representative of your data overall and RCI is not responsible for the application of its analyses to operations, practices or data sets not included in its analyses.
    • B. RCI is not legal counsel and, unless RCI is engaged by your legal counsel, all information you disclose to RCI or that RCI discloses to you may be subject to disclosure to third parties in legal, regulatory or similar proceedings. RCI is not legal counsel and does not opine on whether any particular engagement may be protected from such disclosure. You must consult with your legal counsel regarding the best means for you to engage RCI; RCI assumes you have done so and has no obligation to take any measures to ensure that you have engaged RCI in a manner that best protects your legal interests.
    • C. In its assessment of your business operations, practices or data, RCI makes reasonable efforts to apply federal or state laws or regulations and health plan billing, coding or payment policies in accordance with industry understandings of the same; however, RCI is not legal counsel and does not intend to provide a legal opinion regarding the applicability, interpretation or impact of federal or state law or regulation or health plan billing, coding or payment policies. It is your obligation to obtain legal counsel to ensure that the industry understandings regarding federal or state laws or regulations and health plan billing, coding or payment policies applied by RCI in its assessment of your business operations, practices or data are applicable or correctly applied to your facts and circumstances.
  • III. Forward-looking statements
    • A. RCI business projections, plans, models and similar forward-looking statements are merely RCI’s predictions based on RCI’s experience and information you provide; such forward-looking statements are not guarantees of performance. These forward-looking statements involve significant known and unknown risks, uncertainties and assumptions. Many factors may cause actual performance, results or achievements to be materially different from those included in RCI forward-looking statements. These factors include, but are not limited to, changes of applicable federal and state law and regulation and interpretations thereof, changes in standards of care, changes in competition, changes in payment rates, and the accuracy and completeness of information provided to or obtained by RCI. RCI believes that any forward-looking statements it makes are reasonable as of the date made, but RCI does not intend, and does not assume any obligation, to update or revise forward-looking statements.
    • B. Payment rates used in RCI business projections, plans, models and similar forward-looking statements are for reference only and are not guarantees of actual payment that may be received for a given service or item. Payment rates are subject to change from time to time by health plans and may vary based on geographic region, provider type and the place of service. Further, RCI assumes that services for which payment rates are estimated are medically necessary and provided in accordance with all requirements for payment (i.e. prior authorization, documentation, etc.). Collection rates may not accurately reflect the net revenue that may be received by a provider for a particular item or service; operational costs that may be incurred by a provider necessary to collect payment and shifts of financial responsibility from health plans to individuals may result in net revenue collected by a provider for an item or service that is significantly lower than projected collection rates.
    • C. Projected costs used in RCI business projections, plans, models and similar forward-looking statements are for reference only and are not guarantees of actual costs that may be incurred for a given service or item. Costs are subject to change based on market availability of an item or service, lending costs, currency fluctuations and other factors. Changes in such factors may result in costs for any given project, business plan or model that are materially different than those presented by RCI.
  • IV. Use of RCI Information
    • A. You may only use or rely on RCI work product for those purposes for which it is specifically intended. Disclosure of RCI work product to third parties is not authorized if such work product is modified in any way, including the removal of or changes to any RCI statement regarding the context or limitations of any such work product. If you disclose RCI work product to a third party for any purpose without disclosing all RCI statements regarding the context or limitations of the RCI work product, you are solely responsible to the third party for any damages that are related to such third party’s reliance on the RCI work product and you agree to indemnify RCI for any costs, claims or damages incurred by RCI related to such third party’s reliance on the RCI work product.
